Terms of Service

College Shack takes great pride in protecting user data from messages exchanged between users to photos uploaded by individuals, in fact, all data on our servers are secured. Only those with the proper clearance levels have access to database functions which are used for routine maintenance and never to view private information contained in the databases. The Terms of Service document will outline the guidelines for both the members of our site and our obligation to our members. By using this site, you are bound to the Terms of Service agreement set below by College Shack and the parent company of College Shack, the Foxcore Corporation. College Shack and the Foxcore Corporation (hereby known as "Foxcore" throughout this document) operates this site so that the end-user (hereby know as "member" throughout this document) may communicate with fellow members by the sharing of information regardless of images, messages, groups or other communication means. Foxcore reserves the right to modify, change or delete information on this site with or without prior notice to the member at anytime which may not conform to the terms of service agreement whether it be offensive, racist, or hateful towards groups of certain people or other members. Section 1.0 - Copyright All images, information, blogs and other materials uploaded by a member of the site remains the property of the member and Foxcore does not retain any of this content for it's use either for profit or private use. If Foxcore decides to use materials uploaded by a user, we will always obtain written permission first and never use it without prior consent. Foxcore however does retain the copyright of all materials created by Foxcore. Under no circumstances should any content created by Foxcore (with the exception of unmodified logos available for public use) be used for any reason without prior written consent from Foxcore. Content uploaded by a user not created by a user and without proper papers from the original owners of such material may be removed without notification and may cause your account to be suspended. Do not upload anything you do not own. Section 2.0 - Transmission and Availability Foxcore will make in good faith the availability of this site at all times. However, you release Foxcore from any damages resulting in the unavailability of this website or any of our partner and sub-company websites. Foxcore also will make in good faith the security of the information you may transmit on this site that only authorized users will view this information. However in instances beyond our control such as lack of security on the members computer, network, or a 3rd party network between Foxcore and the user, we are to be released of any damages that may have been caused due to this lack of security or security breaches. The user also agrees to ensure that they are indeed on the official website of Foxcore by viewing the security certificate when applicable or available. We are to be released of any damages due to a counterfeit sites that are unrelated to Foxcore. Foxcore takes great strides in ensuring the safety of your information while in transmission to and from our servers but in some instances, once information leaves our networks, we cannot be responsible for any security breaches outside our control. Hardware failures can happen. We do our best by implementing redundant systems to ensure 24/7 website access but cannot be responsible for the inaccessibility to our network either due to maintenance or circumstances beyond our control. We will do our best to give notice to members of any problems or anticipated downtimes. Section 3.0 - Downloadable Files Foxcore may make files available for members to download in certain instances for specific purposes. The member agrees to release Foxcore from any damages resulting in the downloading of any files hosted on the Foxcore website. The member also understands that any file provided on the site is property of Foxcore and remains the property of Foxcore once it arrives to the member. This is void when the material is owned/uploaded by a member in which that member remains their property of the material obtained. In this instance, the member is also bound to the terms of use of file's rightful member unless otherwise explicitly implied by that member that the content is free to distribute. By downloading files, you understand that at the request of Foxcore or members, whom ever is the rightful copyright owner you are to immediately delete all instances of files that may have been retrieved from Foxcore along with any files created from the result of using the downloaded files. Foxcore does not guarantee any information provided within files to be fully accurate or up to date, use all files off this site at your own risk. When downloading files from other members, you may be subject to damaging programs which may cause harm to your computer. We cannot inspect every file uploaded to our site and you hereby release us of any harm resulting from such problems. Always ensure your anti-virus and other protection services on your computer are up to date. Section 4.0 Acceptable Use Policy Members agree to use College Shack and Foxcore related website properly for their intended uses. Spam is absolutely not tolerated at anytime on our networks. The uploading of, including but not limited to, porn, poor taste imagery, offensive materials, racist materials, are not tolerated at anytime. Commercial use of our network is strictly prohibited unless prior written consent is obtained from Foxcore. Foxcore reserves to remove such comment and take further action against the member violating this clause. Foxcore believes in the freedom of speech and the spread of information as long as it conforms to all applicable state and federal laws. Members found to be violating our Acceptable Use may be immediately suspended with or without notice at our discretion. Fake accounts will be terminated, do not try to impersonate someone you are not. Section 5.0 Changes to Governing Documents Foxcore reserves the right to modify any and all governing documents, including but not limited to the Acceptable Use Policy and Terms of Service. Changes can be made at anytime with or without notice to the member. We will try in good faith to give all members at least a 7 day notice to any changes applying to our governing documents if at all possible. By continuing to use the site after changes have been made to such documents, you agree to abide by the new terms regardless of if you have read them or not. We will always post the date in which the document was last changed. It is the members responsibilty to know, understand and follow all governing documents. Failure to do so may result in legal action or suspension of your account depending on the breach of these documents. These documents are designed to protect all members and Foxcore to ensure a safe environment for all that use our site. Section 6.0 Liabilities The member agrees to hold Foxcore free of any liabilities resulting from the use by the member while accessing this website. We do our best to ensure 24/7/365 redundancy for all systems but sometimes certain parts of the system must be taken down for maintenance. We will do our best to notify members ahead of time when possible. Although we use cutting technology to prevent and alleviate the failure of components (dual power supplies, Mirror Raid Systems, separate servers for different services in our servers, we cannot be held liable for the loss of information. It is recommended that you keep any essential information backed up. The member understands that if they are to break any of the terms of use within this document, they may be subject to civil and/or criminal prosecutions. In the result of any civil or criminal action, all proceedings are to take place in Jefferson County, Colorado for state related prosecutions or the Federal District Court of Denver in the case of federal level actions. The non-prevailing party shall be responsible for, including but not limited to, court fees, attorney fees, research fees, traveling fees and the ruling of the court for both the plaintiff and defendents. Foxcore reserves the right to modify the Terms of Service agreement at anytime with or without notice and the member will automatically be bound to the new Terms of Service.
